Will we be able to order the magazine from some of the larger News Agents in the U.K. i.e. WH Smith.

Will you be starting a magazine forum - I too dropped out of Ufology for a while, it would be interesting to know if the old contacts are still out there! If not could you include a U.F.O. Group page?

You know we love you here at UFO Mag and as a bit of a boost, I've just finished editing Malcolm's review of your book "UFO Case Files of Russia" with Paul Stonehill for our current issue.

He is certainly a big fan of your work, at least in the review!! Laughing

And of course we wish you all success with the very tough job of creating and maintaining a magazine. My offer from a while back stands -- let us know if you need help and we will do what we can. It's a big job, but an even bigger world, so have fun!

The new magazine will be available in high street stores in the UK such as W H Smiths but to make sure you get your copy it is cheaper to subscribe online at: www.healingsofatlantis.com

Thanks for your kind comments Nancy and I know we shall continue to assist each other in any way we can.

Editing such a magazine is something I have wanted to do for a long time and I only hope that I'm up to the job. We've a good team around us so I am very confident that we will succeed.

Thanks for all the kind comments that I have recived from all over the world and don't forget that the launch issue of UFO MATRIX MAGAZINE will be out on July 29th.

As of today I have ended my column and any connection with UFO MAGAZINE. The reason ? A threatening letter from UFO MAGAZINE'S attorney Julie S. Maresca. Why a letter from the attorney you might ask. Well it's because we are starting UFO MATRIX MAGAZINE here in the UK and Bill Birnes thinks he can copyright the phrase and the logo UFO in connection with a magazine. If anyone would like to see a copy of the attorney's letter I'll gladly supply a copy.

To be honest I find this a shameful way to carry on. I had offered cooperation to Nancy between the 2 publications and pointed out that we are not in competition with UFO MAGAZINE or anyone else for that matter. In my opinion this has nothing to do with protecting copyright etc, instead Bill Birnes simply does not want any other magazines around.

It's just a ridiculous state of affairs and I for one will have nothing more to do with UFO MAGAZINE ever no matter what. I've got this magazine since day one and it's now going on the bonfire.

This is ridiculous and utterly infuriating. Of course the company that owns the license for UFO Magazine must protect it or lose it. And please get your facts straight: the license is owned by Motion Picture Licensing Corp., and lawyer Julie works for them.

You are jumping on Bill Birnes just a little too quickly here. He has nothing to do with the logo or copyright. In fact, we are licensing the use of the logo from MPLC ourselves, and it's cost us a lot this year. That company does have the right to use the word "UFO" with 'magazine" and a simple bit of internet work would show you that.

But that's not the problem -- the design of the logo is the problem. Why on earth wouldn't you try to make your new magazine just a little bit original? Since you're calling it UFO Matrix Magazine, you have a lot of ways to create a logo that wouldn't confuse your endeavor with ours.

Why not give the word "Matrix" the emphasis instead of the acronym? Maybe these folks would appreciate the flattery:

Goodbye. You can use all the excuses you like but none of them hold any water. It makes sense to me to highlight the phrase UFO on a publication that deals with this subject and hopefully attracts they eyes of passing people on the newsstands. Maybe we should have asked your permission or your lawyers permission first. I don't think so.

I'll consult with my colleagues but my association with UFO MAGAZINE ends now.

Guilt by association. This is not the first time we've had such a letter, we had one at UFO DATA MAGAZINE as well. It is just plain ridiculous and no end of excuses can hold any water. UFO MATRIX MAGAZINE will be published as scheduled and if UFO MAGAZINE want to waste more time and money on their attorney then that is their choice of course. Maybe Bill Birnes could try again to have Maurizio Baiata arrested as he did a couple of years ago at Laughlin. Maurizio now edits OpenMinds magazine and we cooperate with each other without any leters from attorneys. Its a shame UFO MAGAZINE are unhable to do the same.

It seems that in today's world of evolving technology that producing a magazine has gotten harder. It seems that any paper version of information is going by the wayside.

As owners and editors wrestle with this, what do you think the percentages are that people are leaning toward on line vs paper copies?

Back again.

Don't you just love it when self-described UFO "investigators" not only get their facts wrong, don't bother to read their documents carefully, confuse the issues -- perhaps willfully -- and then pound the table with insults because it's the only type of argument they can muster. Stan Friedman is correct when he says that you can't change people's minds with facts when their minds are locked up in their own prejudices. And Bruce Maccabee is correct when he says that the last resort of a prejudiced mind is to throw any argument on the pile just to avoid having a void. And Phil Mantle's post above certainly fills that bill.

First, he ignores any arguments in my post, e.g., we didn't send the letter, we don't own UFO Magazine, Inc., and we don't own the trademark to UFO®️. Therefore, we are not a party in standing in this controversy. If he wants to take his argument somewhere, take it to UFO Magazine, Inc. Nancy and I are just handy targets for his vituperation and venting of frustration.

Second, he acts surprised. Why is he surprised when a few years ago he tried to promote a magazine called UFO Data in the US as well as the UK and received the same letter? Is he so willfully blind that he repeats the same act and expects a different result?

Third, this has nothing to do with copyright, as Mantle incorrectly asserts, because you can't copyright a name. You can register a trademark for a name or a logo, which is what UFO Magazine, Inc., did all the way back in 1998. Why did they do it? Were they trying to own the field, keep anyone else from talking about UFOs, copyright every piece of information? No.

If you look at the registry information in the US Patent and Trademark Office online, you will find the term UFO trademarked for everything from shoes to beer. A trademark is simply a way of protecting the name of your product within a specific stream of commerce or goods and services. It doesn't mean that another company can't manufacture shoes, brew beer, or publish a magazine about UFOs. You just can't use a logo or a mark that could be considered by the United States Trademark Office to cause substantial confusion to the detriment of a registered trademark holder.

This doesn't mean that Mantle can't publish his magazine in the UK with any name he chooses. Mantle misconstrues the letter he received from the attorney. He can do what he wants in the UK. The letter only claims that the look of Mantle's UFO on his cover is so similar to the look of UFO®️ Magazine, Inc.'s logo that there is the substantial possibility of confusion. Which is, of course what Mantle is hoping for. And he got caught again.

By the way, speaking of the ways in which self-described UFO "investigators" not only don't investigate the facts, get their facts wrong, work from rumor and false belief systems instead of doing their own research, and wind up spending more time spamming and insulting others instead of doing their homework, Mantle falsely asserts that I had Maurizio Baiata "arrested." Where does he come up with this information?

Again: the facts -- retrievable by any real investigators who choose to do their homework -- are that the lawsuit came from a company called Corso Holdings, Inc., not me and not UFO Magazine. It was filed in the name of the Corso family on behalf of their claims that Baiata and the Italian publishing company he worked for had breached a publishing contract, not paid royalties that were due, and infringed on the late Philip J. Corso's registered copyright.

I was not a plaintiff in this lawsuit. Corso Holdings, Inc. was the plaintiff. It was a civil suit not a criminal complaint. Baiata was never arrested only served with a summons and civil complaint. The civil lawsuit for copyright infringement and breach of contract was filed in federal court in Los Angeles. Baiata and the publisher settled. But the federal court in Los Angeles still retains jurisdiction.

All of Mantle's facts are wrong. Yet he asserts them in spams in any forum that lets him in. And not only is he dead wrong, he adamantly refuses to look at the real facts. Why is he making such false accusations? If he wants to be on our radio show -- he spammed in the Future Theater Radio forum (www.futuretheater.com) -- why can't he just write an email to us asking to be a guest and calling us out on the radio? Nope, too civilized. Instead, he has to take his false bluster over to another forum that has nothing to do with UFO Magazine, Inc., and post the same venom there.

So here's the open invitation: you want to discuss this like a human being who believes himself to be an investigator of facts? Fine. Let's come up with a date and set it up, and everyone is invited to listen in, download the archive, and judge for themselves.

Now you've been called out.

I was not a plaintiff in this lawsuit. Corso Holdings, Inc. was the plaintiff. It was a civil suit not a criminal complaint. Baiata was never arrested only served with a summons and civil complaint. The civil lawsuit for copyright infringement and breach of contract was filed in federal court in Los Angeles. Baiata and the publisher settled. But the federal court in Los Angeles still retains jurisdiction.

All of Mantle's facts are wrong. Yet he asserts them in spams in any forum that lets him in. And not only is he dead wrong, he adamantly refuses to look at the real facts. Why is he making such false accusations? If he wants to be on our radio show -- he spammed in the Future Theater Radio forum (www.futuretheater.com) -- why can't he just write an email to us asking to be a guest and calling us out on the radio? Nope, too civilized. Instead, he has to take his false bluster over to another forum that has nothing to do with UFO Magazine, Inc., and post the same venom there.

So here's the open invitation: you want to discuss this like a human being who believes himself to be an investigator of facts? Fine. Let's come up with a date and set it up, and everyone is invited to listen in, download the archive, and judge for themselves.

Now you've been called out.

Second, he acts surprised. Why is he surprised when a few years ago he tried to promote a magazine called UFO Data in the US as well as the UK and received the same letter? Is he so willfully blind that he repeats the same act and expects a different result?

Third, this has nothing to do with copyright, as Mantle incorrectly asserts, because you can't copyright a name. You can register a trademark for a name or a logo, which is what UFO Magazine, Inc., did all the way back in 1998. Why did they do it? Were they trying to own the field, keep anyone else from talking about UFOs, copyright every piece of information? No.

If you look at the registry information in the US Patent and Trademark Office online, you will find the term UFO trademarked for everything from shoes to beer. A trademark is simply a way of protecting the name of your product within a specific stream of commerce or goods and services. It doesn't mean that another company can't manufacture shoes, brew beer, or publish a magazine about UFOs. You just can't use a logo or a mark that could be considered by the United States Trademark Office to cause substantial confusion to the detriment of a registered trademark holder.

This doesn't mean that Mantle can't publish his magazine in the UK with any name he chooses. Mantle misconstrues the letter he received from the attorney. He can do what he wants in the UK. The letter only claims that the look of Mantle's UFO on his cover is so similar to the look of UFO®️ Magazine, Inc.'s logo that there is the substantial possibility of confusion. Which is, of course what Mantle is hoping for. And he got caught again.

By the way, speaking of the ways in which self-described UFO "investigators" not only don't investigate the facts, get their facts wrong, work from rumor and false belief systems instead of doing their own research, and wind up spending more time spamming and insulting others instead of doing their homework, Mantle falsely asserts that I had Maurizio Baiata "arrested." Where does he come up with this information?

Again: the facts -- retrievable by any real investigators who choose to do their homework -- are that the lawsuit came from a company called Corso Holdings, Inc., not me and not UFO Magazine. Don't you just love it when arrogant self-styled magazine publishers get their facts wrong. First of all you may not have sent the letter but it's a matter of collective responsibility here I'm afraid. Just to show you how wrong you are (again) you mention UFO DATA MAGAZINE. This self published title was owned by Russ Callaghan and Michael Buckley and not I. I just worked on it free of charge. They did receive one of these silly letters (can you see a pattern here?) but this mag was never promoted in the USA by myself or anyone else so far as I know. Birnes can't even get that right so one wonders what else he's got wrong. I'd also like to know which other forums I've made comments in ? None as far as I'm aware. If it has appeared on another forum it has nothing to do with me. Check your facts Birnes, I did make an offer to discuss this. I personally have no problem wit this but after a phone call to my legal advisor this morning I have been advised to say no more until I meet them.

If I am incorrect about Maurizio then I stand corrected but at least I am able to do that, shame Birnes can't do the same.
